Workers CompensationWrongful DeathGalveston County Lawsuit Claims 12 Companies Responsible for Employee’s Death

According to the Southeast Texas Record, court documents show that 12 companies face a lawsuit following a former oil refinery operator’s death, caused by on-the-job asbestos exposure.

In Galveston County District Court, on November 4, the children of a former refinery worker launched the lawsuit against the defendants, among them General Electric Co. and CBS Corp.

The deceased worker was employed at the Texas City Refining Inc. facilities for 40 years, from 1954 to 1994. According to the lawsuit, he was “exposed to asbestos dust and/or fibers” during the course of his employment, especially prior to 1980.

The family’s claims states, “As a result of his exposure to asbestos dust and/or fibers while employed by Texas City Refining Inc. [the employee] contracted asbestos-related mesothelioma which ultimately took his life.” The lawsuit alleges that there were defects in the design and marketing of “the defendants’ asbestos-containing products and/or machinery,” contending that all 12 companies had prior knowledge of the dangerous substance but negligently failed to warn employees.

My Loved One Was Killed by On-The-Job Asbestos Exposure and I Need an Attorney

Asbestos is a substance that is hazardous to human health. Recently, scientists learned that exposure to asbestos could cause serious health conditions, including lung cancer and mesothelioma. The generators and turbines found in plants and factories prior to the 1980’s contained asbestos; as a result, many plant workers who worked in oil refineries, chemical plants and power plants have been exposed to the dangerous substance.

Employers have an obligation to provide a safe environment for their employees. When they fail to do so, they are putting lives at risk, and should be held liable for their negligence. If you or a loved one has been injured or killed due to an employer’s negligence, you should file a workers’ compensation claim.
