Imprisoned Patient Sues Doctor Over Infection and Injuries

A Henderson County, Texas resident has filed a lawsuit against a Huntsville surgeonPhoto of document alleging medical negligence in a 2011 case. The Athens man sued the doctor July 6, alleging liability in a number of medical operations he claims caused an infection and injuries between 2011 and 2014. According to the lawsuit, the plaintiff was diagnosed with renal failure in August 2011 and referred to the doctor for failure. In October 2011, following surgery to insert a catheter, he began dialysis at his home.

The suit states that due to an alleged violation of his pre-existing parole status, the plaintiff was remanded to a state hospital in Huntsville in April 2013. While negotiating continued dialysis treatment, he discovered that his catheter no longer functioned, causing him to develop peritonitis at the implant site. E. Coli and staph were behind the patient’s infection, according to the suit, and that after additional surgery, his pain worsened and fluid leaked from his wound. A CT scan revealed his bladder had been punctured during surgery. He underwent another procedure and, when he recovered, he claims he was denied his previous treatment method and forced to settle for hemo-dialysis at the prison hospital for almost a year until his release in April 2014.

Alleging medical negligence, severe physical pain, mental anguish, impairment, and medical expenses, the plaintiff blames the defendant for inadequate care. The doctor failed to flush and properly maintain the peritoneal catheter, which led to an infection and several surgeries, the plaintiff alleges. The plaintiff seeks up to $250,000 in compensation.
